THAT BREAKING NEWS THIS AFTERNOON, THE IOWA AG’S OFFICE SAYS THERE WILL BE NO CHARGES AGAINST THE DES MOINES POLICE OFFICERS WHO KILLED A MAN DURING A SHOOTOUT BACK IN SEPTEMBER. THE AG’S OFFICE FOUND THAT SENIOR POLICE OFFICER JACOB BOYKOFF, OFFICER FRANKIE CONTRERAS AND CAPTAIN CHAD STEFFEN WERE JUSTIFIED WHEN THEY SHOT JOSHUA GREENE. DES MOINES POLICE OFFICER KADE MORITZ WAS SHOT IN THE HEAD DURING THE EXCHANGE OF GUNFIRE. BOKOV WAS HIT IN THE ARM. BOTH OFFICERS ARE STILL RECOVERING FROM THEIR INJURIES. NOW THIS ALL UNFOLDED NEAR EASTON BOULEVARD AND HUBBELL AVENUE. POLICE SAY GREENE DROVE AWAY FROM POLICE DURING A TRAFFIC STOP. HE CRASHED SOON AFTER. THE REPORT SAYS GREENE REFUSED TO GET OUT OF THE CAR. OFFICERS THEN TASED HIM AND HE FELL TO THE GROUND. THERE, HE ROLLED OVER AND PULLED OUT A GUN AND FIRED AT OFFICERS. OFFICERS BO FRANKIE CONTRERAS AND CAPTAIN CHAD STEPHAN RETURNED FIRE, KILLING GREENE. GREENE’S PASSENGER, SHAWNA CUNNINGHAM, IS ACCUSED OF PROVIDING HIM WITH THE GUN. The Iowa Attorney General's Office says there will be no charges filed against the Des Moines police officers who killed a man during a shootout in September.The attorney general's office found that Capt. Chad Steffen and Senior Police Officers Jacob Boekhoff and Frankie Contreras were justified when they shot Joshua Green on Sept. 16.Officer Cade Moritz was shot in the head during the exchange of gunfire, and Boekhoff was hit in the arm. Both are still recovering from their injuries.It all unfolded near Easton Boulevard and Hubbell Avenue in the early morning hours of Sept. 16 when police say Green drove away from an attempted traffic stop.He crashed soon after and refused officers' commands to turn off his vehicle and surrender."The officers approached Green and warned him that he would be tased if he did not comply," the attorney general's report said. "When Green continued not to comply, an officer tased him twice. Both attempts failed. Green even pulled the attached barbs from the taser out of his body. An officer then pulled Green out of the vehicle by the foot that Green had hanging out of the driver’s side door. Green fell to the ground, only to quickly sit back up, draw a handgun from his waistband, and started shooting. Until that point, the officers were unaware that Green was armed. Green shot one officer in the arm and another in the head. returned fire, killing Green."Green's fiance, Shawnna Cunningham, was in the passenger seat during the incident. Cunningham, 47, has been charged with having a firearm as a drug user and for aiding and abetting the possession and disposal of a gun to someone she knew was a felon. She admitted to owning the handgun and having it with her in the car before Green used it to shoot the officers, according to court documents, but denied giving it to him.
