INVESTIGATORS SAY WESTON DARBY POINTED A GUN AT OFFICERS BEFORE THEY OPENED FIRE, AND ONE OF THOSE OFFICERS WAS HIT BY FRIENDLY FIRE AND IS NOW RECOVERING IN THE HOSPITAL. THIS EVENING. HE’S EXPECTED TO BE OKAY. THE VICTIM GOES ON TO STATE DARBY INSTANTLY ATTACKED THEM, KNOCKING OVER THE CHAIR THE VICTIM WAS SITTING IN AND THROWING THE VICTIM’S PHONE. THEY WRITE QUOTE. HE GRABBED ME AND MADE ME LOOK IN HIS EYES AND SAID, IF YOU TELL ANYONE I’M GOING TO MURDER YOU. ON ANOTHER OCCASION, THE VICTIM SAYS, DARBY HIT THEM WITH A BOARD. ANOTHER NEBRASKAN WHO FILED A NO CONTACT ORDER AGAINST HIM LAST AUGUST, DESCRIBES SEVERAL INCIDENTS IN WHICH DARBY WOULD THREATEN THEM AND HIT THEM. THE VICTIM ALSO CLAIMED DARBY REPEATEDLY ATTEMPTED TO BLACKMAIL THEM INTO HAVING SEX WITH HIM. DES MOINES POLICE AND IOWA DCI ARE STILL INVESTIGATING WHAT HAPPENED WHEN DARBY SHOWED UP AT THE DES MOINES VICTIM’S HOME. Authorities have identified the man who was killed by officers after a report of a no-contact order violation turned into a chase and a shooting.Officers were called to a residence in the 5800 block of SE 35th Circle for a report of a person violating a protective order. Police found the suspect, who has since been identified as Weston Dean Derby, 45, of Bellevue, driving near the scene and attempted to stop his vehicle. A chase ensued before Derby's vehicle came to a stop in the 4300 block of East Army Post Road. Des Moines police Sgt. Paul Parizek said officers' body camera footage shows Derby attempting to flee on foot before turning to face the two officers in pursuit and pulling a handgun."He initially points it towards his own head," Parizek said. "... He transitions from that to a two-fisted pointing right at the officers. Both officers did fire their weapons. And one of the officers was hit and the suspect was also hit."Derby was pronounced dead at the scene.One of the two officers was apparently struck by friendly fire, Parizek said.
