Iowa Attorney General's Office says DMPD officers were justified in February deadly shooting; no charges filed
BREAKING NEWS. THAT BREAKING NEWS IS OUT OF MARION COUNTY THIS EVENING, WHERE CREWS ARE BATTLING A FIRE AT A FERTILIZER STORAGE FACILITY IN OTLEY. PEOPLE WITHIN A HALF MILE OF THE FIRE WERE FORCED TO EVACUATE. IT鈥橲 HAPPENING AT TWO RIVERS COOPERATIVE ON BUSINESS HIGHWAY 163. 糖心vlog SENIOR REPORTER TODD MAGEL IS LIVE IN OTLEY TONIGHT. AND, TODD, WHAT ARE THINGS LOOKING LIKE RIGHT NOW? LAUREN JODI THINGS ARE LOOKING A LITTLE BETTER NOW THAN THEY WERE A FEW HOURS AGO. WHEN YOU CAN SEE THICK BLACK SMOKE FOR MILES AROUND HERE. TAKE A LOOK AT JUST BEHIND ME. HERE YOU CAN SEE THE ROADS ARE STILL CLOSED INTO TOWN. AFTER THE WHOLE TOWN WAS EVACUATED THIS AFTERNOON. AND IF YOU LOOK JUST A COUPLE OF BLOCKS SOUTH FROM WHERE WE鈥橰E STANDING HERE, YOU CAN SEE THE FIRE IS STILL BURNING THERE. IT LOOKS MUCH BETTER NOW THAN IT DID JUST A FEW HOURS AGO, WHEN YOU COULD SEE THAT SMOKE. TAKE A LOOK AT SOME VIDEO WE GOT FROM A NEIGHBOR WHO LIVES JUST ACROSS THE STREET FROM THE STORAGE BUILDING HERE. IT鈥橲 PART OF THE CO-OP, AND IT CLEARLY SHOWS A PRETTY BIG FIRE JUST AFTER IT STARTED EARLIER TODAY. AND EVENTUALLY, WE鈥橰E TOLD, AN EXPLOSION OR A BLAST BLEW THE ROOF OFF OF THE BUILDING. IT CONTAINS HUNDREDS AND HUNDREDS OF TONS OF DIFFERENT KINDS OF CHEMICAL FERTILIZERS. THEY ARE DANGEROUS ENOUGH THAT THEY DID HAVE TO EVACUATE THE TOWN BECAUSE OF THAT. WE TALKED TO ONE BUSINESS OWNER WHO WAS SHOCKED WHEN HE SAW THAT FIRE GROW. SO I WALK OUT AND LOOK A BLOCK DOWN THE ROAD AND THE FERTILIZER SHED IS ON FIRE. AND OH, PROBABLY UP UNTIL ABOUT 2:00. IT WAS JUST LITTLE PUFFS OF SMOKE. AND MY WIFE WAS IN TOWN. SHE FORGOT HER WALLET HERE AND HAD TO GO GET HER SOME GAS AND TURN AROUND AND. OH, MY. OTLEY IS BLACK. NOW. WE COULD SEE THE SMOKE FROM THIS FIRE MILES AWAY AS WE DROVE INTO TOWN THIS AFTERNOON. WE DID GET A NEWS RELEASE FROM OFFICIALS, AND THEY SAY AT THE SCENE NOW, THEY DON鈥橳 HAVE A CAUSE OF THE FIRE, BUT THEY DO BELIEVE BECAUSE THERE ARE SO MANY CHEMICALS THERE THAT THIS FIRE COULD BURN FOR DAYS, AND IT MAY TAKE THEM THAT LONG TO GET BACK IN TO FIND OUT WHAT HAPPENED. BUT AGAIN, NO ONE INJURED HERE IN OTLEY. WE鈥橰E LIVE IN OTLE

Officers Titus DeFord and Neal Shaffer opened fire, hitting Kintz. Kintz later died from his injuries.

The Iowa Attorney General's Office's report says Kintz had previously told members of his family he did not want to go back to prison and would "make [law enforcement] kill me" if they tried to arrest him.

The report concludes the officers' lives were in danger and they were justified in using deadly force.

Polk County Attorney Kimberly Graham released a letter with similar findings on Monday, saying, "It is my conclusion that the use of deadly force was legally justified pursuant to Iowa law. No charges will be filed by our office."
