How much jail time could Alec Baldwin face for involuntary manslaughter?
PROGRAMING OR RIGHT. THANK YOU FOR STICKING WITH US. WE JUST WANT TO GO OVER THESE CHARGES THAT JUST CAME DOWN AND WITHIN THE LAST HOUR THE SUMMARY OF THE CHARGES, ALEC BALDWIN, TWO COUNTS OF INVOLUNTARY MANSLAUGHTER. AND HE HAD READ TWO COUNTS OF INVOLUNTARY MANSLAUGHTER. DAVID HALL’S ASSISTANT DIRECTOR, GUILTY PLEA FOR NEGLIGENT USE, A DEADLY WEAPON AND WILL BE SENTENCED SIX MONTHS OF PROBATION. NO CHARGES AGAINST DIRECTOR JOEL SOUSA. LET’S IN JOHN DAY AGAIN, OUR LEGAL EXPERT HERE AT KOAT. SO, JOHN, AGAIN IS ALL JUST COMING DOWN JUST MINUTES AGO. LET’S REHASH AGAIN JUST IN CASE PEOPLE ARE JUST JOINING US RIGHT NOW. WHAT THIS INVOLUNTARY MANSLAUGHTER CHARGE MEANS. WELL, IT MEANS NO ONE HAD AN INTENT TO KILL SOMEONE. BUT THE FACT IS IS THAT THEIR ACTIONS WERE SO NEGLIGENT THAT SOMEBODY DIED AND IT HAS TO RISE ABOVE SIMPLE, SIMPLE NEGLIGENCE TO THE LEVEL OF NEGLIGENCE. AND THE FACT THAT THAT THE D.A. HAS DECIDED TO CHARGE THE. AND ALSO ALEC BALDWIN MEANS THAT SHE WANTS TO SEND A MESSAGE THAT. GUNS ARE DEADLY SERIOUS. DOESN’T MATTER WHETHER IT’S A FILM OR SOMEONE’S BACKYARD THAT. AND I THAT LANGUAGE IN HER ISSUED MEDIA RELEASE WHERE SHE REITERATED THAT THAT’S THAT THEY’RE FOCUSING ON THE SERIOUSNESS OF PLAYING AROUND WITH GUNS AND THEY WANT TO SEND A MESSAGE. AND JOHN, LET’S TALK ABOUT WHAT HAPPENS NEXT. WE HEARD ABC NEWS JUST MENTIONED A PRELIMINARY HEARING. WHAT IS GOING TO HAPPEN IN THAT PRELIMINARY HEARING. A PRELIMINARY HEARING LIKE A MINI TRIAL WHERE THE PROSECUTOR PRESENTS ITS EVIDENCE TO A JUDGE. IT’S NOT A GRAND JURY WHERE THEY HAVE A SECRET MEETING WITH 12 PEOPLE. IN A PRELIMINARY HEARING, IT’S OUT IN THE OPEN. THE PROSECUTION, THE EVIDENCE TO A JUDGE AND THE JUDGE DECIDES IF THERE’S PROBABLE TO MOVE FORWARD WITH THE CASE AND THE DISTRICT COURT. JOHN, I WANT TO TOUCH ON DAN ABRAMS. ABC’S EXPERT, WAS JUST TALKING ABOUT WITH INVOLUNTARY MANSLAUGHTER PENALTY IN NEW MEXICO COULD BE UP TO 18 MONTHS IN PRISON. BUT ALSO THAT THE D.A. ADDED THIS EXTRA ELEMENT OF A FIREARM IN MEANT SO THERE COULD BE SOME SERIOUS TIME BEHIND BARS BECAUSE OF THIS. YEAH THE FIREARM ENHANCEMENT ADDS POTENTIAL FIVE YEARS TO ANY CHARGE. NOW THE REALITY IS IS THAT APPARENTLY NONE OF THESE PEOPLE HAVE ANY CRIMINAL HISTORY. AND, YOU KNOW, WHEN WE GET DIFFERENT WHEN WE GET TO A SENTENCING, GOING TO BE UP TO A COURT BUT. THE FACT THAT THERE’S A FIREARM ENHANCED MEANT ADDED TO IT AND NOT SURPRISINGLY BECAUSE THERE’S A FIREARM USED. BUT THAT COULD ADD FIVE YEARS TO THE NORMAL 18 MONTH SENTENCE FOR A FOURTH DEGREE FELONY. AND MANSLAUGHTER. AND JOHN, LET’S TALK A LITTLE BIT ABOUT THESE CHARGES. YOU KNOW, ALEC BALDWIN SAYING EARLIER IN PREVIOUS INTERVIEWS THIS CAME DOWN THAT HE WAS NOT EXPECTED TO BE CHARGED WITH ANYTHING CRIMINALLY. YOU SURPRISED BY TODAY’S ANNOUNCEMENT? NOT I THINK THAT THE DISTRICT ATTORNEY TRYING TO TAKE HER TIME AND BE THOUGHTFUL ABOUT THIS. I THINK BALDWIN’S EFFORTS AND STRATEGY OF TRYING TO SPIN THIS EARLY ON, OBVIOUSLY DIDN’T MAKE A DIFFERENCE. AND IT CERTAINLY MAKES THEM LESS THAN I THINK. IT’S CERTAINLY UNDERSTANDABLE WANTING GET OUT THERE AND SAY, I DIDN’T DO ANYTHING WRONG. BUT I THINK HE MADE SOME STATEMENTS WHERE HE SAYS, WELL, PEOPLE IN THE KNOW HAVE TOLD, I’M GOING TO BE FINE. I’M IN THE CLEAR. AND FROM A DEFENSE PERSPECTIVE, JUST NOT A GOOD IDEA. ALL RIGHT, JOHN DAY, OUR LEGAL EXPERT, JUST GOING OVER THESE CHARGES THAT JUST CAME INTO OUR NEWSROOM WITHIN THE LAST HOUR OR SO. SO WE’RE GOING TO HAVE TEAM COVERAGE OF THIS RUSSELL FILM SET SHOOTING CHARGES JUST ANNOUNCED TODAY FROM THE SANTA FE DISTRICT, GOING TO BE GLASSES WORKING ON IT BEHIND, THE SCENES RIGHT NOW. SHE’S GOING TO HAVE A COUPLE OF FULL REPORTS FOR YOU. COMING UP AT 11:00. WE’RE GOING TO TALK TO JOHN DAY THROUGHOUT THE DAY AS WE BREAK DOWN THIS EMAIL THAT CAME FROM THE DISTRICT. WE’LL HAVE MUCH MORE TODAY AT 1145, SIX AND TEN. THANKS FOR WATCHING.

How much jail time could Alec Baldwin face for involuntary manslaughter?
First Judicial District Attorney Mary Carmack-Altwies and special prosecutor Andrea Reeb have announced two involuntary manslaughter charges will be filed against 'Rust' actor and producer Alec Baldwin and the movie's armor Hannah Gutierrez-Reed. In a statement issued by the district attorney, Baldwin and Gutierrez-Reed will be "charged in the alternative." That means a jury would decide not if they were just guilty, but under which definition of involuntary manslaughter they were guilty. The first charge of involuntary manslaughter must be proved that there was underlying negligence. New Mexico state laws mark this charge of involuntary manslaughter as a fourth-degree felony with up to 18 months in jail and up to a $5,000 fine. The DA says this charge also includes a misdemeanor charge of negligent use of a firearm and could merge together. The second charge is involuntary manslaughter in the commission of a lawful act. This charge must prove there was more than simple negligence involved in a death. This second charge is also punishable with up to 18 months in jail and up to a $5,000 fine. This particular charge includes a firearm enhancement, which means there's an added penalty that is mandatory because a firearm was involved. The enhancement includes a mandatory five years in jail. The charges will formally be filed in New Mexico's First Judicial District Court by the end of January. Each person charged will be required to make a first appearance in court. Assistant director David Halls has also signed a plea agreement for negligent use of a deadly weapon. The terms of the plea agreement include a suspended sentence and six months of probation.
